of Ukrainian Stone Mills LLC

These Terms of Use for the website https://the-miller.com/ (hereinafter – the Terms and the Website) are concluded between the website visitor (hereinafter – the User) and Ukrainian Stone Mills LLC (hereinafter – the Company) and regulate the ways of using the Company’s Website, all information available on the Website, as well as all products and services provided by the Company through the Website (hereinafter — Services).

1. General Provisions

1.1. By using the Website or any part of it, the User automatically gives full and unconditional consent to all terms of the Company’s Rules and undertakes obligations in accordance with these Rules.

1.2. If the User does not agree with the terms of the Rules (in whole or in part), they should immediately leave the Website. In such a case, using the Website, any information on the Website, and the Services of the Website is prohibited.

1.3. If the law of the country of residence or stay, for any reason, prohibits or restricts the use of the Website, the User should refrain from visiting it. Any use of the Website in such a situation is the responsibility of the User, while these Terms remain in effect.

1.4. Information published on the Website in the form of news, articles, product and service descriptions, and other informational materials of the Company is relevant as of the date of their creation. Over time, or due to subsequent events, some of this information may become incomplete or outdated. After publication on the Website, the Company does not guarantee prompt updates of such information.

1.5. The opinions of the authors of articles, news, comments, and reviews posted on the Website may not coincide with the opinion and position of the Company.

1.6. The right to use the Company’s trade name, trademarks, domain names, and other distinctive signs may be granted exclusively with the Company’s written consent.

1.7. These Terms may be amended and/or supplemented by the Company unilaterally without any special notice.

1.9. The Company recommends that Users regularly check the Terms for any changes and/or additions. Continuing to use the Website after changes and/or additions to the current Rules signifies the User’s acceptance and consent to such changes and/or additions.

2. Rights, Obligations, and Responsibilities of the Parties

2.1. The User undertakes to use the Website exclusively for purposes that do not contradict the Company’s Privacy Policy, these Terms, other Company Policies, the current legislation of Ukraine, as well as the principles of reasonableness, good faith, and morality.

2.2. The User is obliged to provide and post on the Website accurate information, as well as truthful, complete, and up-to-date personal data.

2.3. If the User believes that the Website contains information that violates their rights, they should send a message to Ads@the-miller.com and provide all information confirming the violation of their rights.

2.4. In the event that the User provides false information regarding the violation of their rights, they bear full responsibility for any damages and expenses incurred in connection with this.

2.5. The User is prohibited from:

  • Distorting information about themselves or their relationships with other persons or organizations;

  • Using any computer programs to collect information on the Website and/or interact with the Website and its services;

  • Conducting unlawful collection, systematization, storage, and distribution of personal data of other Users;

  • Performing actions aimed at disrupting the normal functioning of the Website and its services, as well as the functionality of computer equipment and software;

  • Uploading, storing, publishing, distributing, granting access, or otherwise using viruses, trojans, and other harmful programs;

  • Uploading, storing, publishing, distributing, granting access, or otherwise using any information that:
     

    • Is illegal or contradicts the Terms and Policies of the Company;

    • Contains calls to violate the order established by the Constitution of Ukraine and the laws of Ukraine;

    • Contains obscene expressions, even using masking symbols, e.g., “*”;

    • Contains threats and intimidation;

    • Distributes unsolicited email, spam;

    • Has no meaningful content;

    • Misleads other users;

    • Contains advertising, pornographic, or erotic materials;

    • Contains threats, discredits, insults, humiliates honor and dignity or business reputation, or violates the privacy of other Users or third parties;

    • Contains extremist materials;

    • Promotes criminal activity or contains advice, instructions, or guides on committing crimes;

    • Violates other rights and interests of individuals and legal entities, or the requirements of Ukrainian law.
       

  • Posting any other information that, in the Company’s opinion, is undesirable, does not correspond to the purpose of creating the Website, infringes on the interests of Users, or is otherwise considered undesirable for placement on the Website;
     

  • Reproducing, duplicating, copying, selling informational materials posted by the Company on the Website and/or owned by the Company under intellectual property rights for any purposes, except where such actions are explicitly permitted to the User under a separate agreement with the Company.

2.6. The User bears personal responsibility for any information they post on the Website, report to the Company, and/or other Users.

2.7. Rights of the Company:

  • In the event the User posts information on the Website, or performs other actions that contradict the Rules, or where it is difficult to determine compliance with the Terms and/or applicable law, the Company has the right, at its discretion and without notice, to delete the User-posted information in whole or in part.

  • The Company has the right to limit the functionality of the Website, close access to it, or modify the Website wholly or partially without prior notice to the User.

2.8. Responsibilities of the Company:

  • The Company is not responsible for the use or non-use of the Website by the User, including the inability to use the Website.

  • The Company does not undertake obligations to verify, control, or modify information posted by the User on the Website, as well as for its accuracy and legality.

  • The Company is not responsible for the content of websites linked from the Company’s Website, nor does it guarantee their availability or proper functioning.

3. Intellectual Property Rights

3.1. All objects placed on the Company’s Website, including design elements, text, graphic images, illustrations, audio and video, programs, scripts, and other objects and their combinations (hereinafter – Content), are objects of intellectual property and exclusive rights of the Company, except for objects provided by other rights holders.

3.2. Except as provided by these Terms and the current legislation of Ukraine, the Content may not be copied (reproduced), modified, distributed, published, transmitted, sold, or otherwise used in whole or in part without prior permission from the Company or the rights holder, unless the Company or the rights holder has explicitly granted consent for the User to use the Content.

3.3. User’s use of the Content is allowed exclusively for non-commercial informational purposes, with the mandatory preservation, in each individual case of using Content from the Website, of all authorship marks (copyrights), insertion of a hyperlink to the Website https://the-miller.com/, preservation of the author’s name unchanged, and preservation of the Content unchanged.

3.4. By posting Content on the Website that legally belongs to them, the User grants other users a non-exclusive right to use it by viewing, reproducing (including copying), modifying, and other rights, except in cases where such use harms or may harm the legitimate interests of the rights holder.

3.5. The User bears personal responsibility for any Content and/or other information they publish on the Website or through it, as well as for the use of Content and/or any information from the Website.

3.6. By placing their Content on the Website, the User automatically and free of charge grants the Company a non-exclusive right to use it by copying, reproducing, publicly displaying, adapting, translating, and distributing it for the purposes of the Website, including for its promotion.

3.7. The User has the right to publish their own Content.

3.8. By posting any information on the Website containing intellectual property objects, the User guarantees that they do not infringe the copyrights and other rights of third parties.

3.9. These Terms do not grant the User any exclusive property rights to any intellectual property objects of the Company or third parties, unless explicitly stated otherwise; that is, all ownership rights to such objects remain exclusively with the Company and/or the respective third parties.

4. Third-Party Websites and Content

4.1. The Website may contain links to other websites on the Internet (hereinafter – third-party websites), as well as articles, photographs, illustrations, graphic images, audio and video, information, attachments, programs, and other Content that belongs to or comes from third parties (third-party Content), which is the result of intellectual activity, complies with Ukrainian legislation, and is protected by it.

4.2. The Company is not responsible for any information posted on third-party websites accessed by the User through the Website or through third-party Content, including any opinions or statements on third-party websites or in third-party Content.

4.3. Links to any website, product, service, or any commercial or non-commercial information posted on the Website do not constitute approval or recommendation of these products/services by the Company.

4.4. If the User decides to leave the Website and visit third-party websites and/or use or install third-party programs, they do so at their own risk. From that moment, these Terms no longer apply to the User, and they should follow the Terms and policies of the third-party websites
